Governing Law: Kingdom of Thailand
1. Definitions
- "Estora", "we", "us", "our" — refers to the business operating as Estora, located at 96 Phaya Thai Road, Ratchathewi, Bangkok 10400, Thailand.
- "Services" — the estate records organisation programmes offered by Estora, including the Gentle Sorting Session, Wishes Recording Workshop, and Family Records Programme.
- "Client", "you", "your" — any individual or household who engages Estora's Services.
- "Agreement" — these Terms and Conditions together with any session confirmation correspondence.
- "Session Summary" — the written document produced at the conclusion of each session, provided to the client.
2. Acceptance of Terms
By enquiring about, booking, or attending any Estora session, you indicate that you have read, understood, and accepted these Terms and Conditions. If you do not accept these terms, please do not engage our Services.
Our Services are available to individuals aged 18 and over who have the legal capacity to enter a service agreement in Thailand. Estora reserves the right to decline any engagement at its discretion.
3. Service Description
Estora provides organisational and educational support for individuals and families who wish to sort, label, and maintain personal estate records, and to record their own wishes and intentions in a non-binding format.
Important scope limitation: Estora does not provide legal advice, financial advice, notarial services, tax guidance, or any service requiring a professional licence. Nothing produced during a session constitutes a legally binding document. Clients are responsible for engaging appropriately qualified professionals for any matters that require formal professional input.
Services are available to clients based in Bangkok and surrounding areas of Thailand. Home visit sessions are available within the Greater Bangkok area by arrangement.
4. Booking and Scheduling
Sessions are booked by enquiry. A session is confirmed when Estora sends a written confirmation by email. Estora reserves the right to reschedule sessions with reasonable notice due to staff illness or circumstances beyond our control.
Clients wishing to cancel or reschedule must notify Estora at least 48 hours before the scheduled session. Cancellations with less than 48 hours' notice may incur a cancellation charge of 50% of the session fee. No-shows without prior notification will be charged in full.
5. Payment Terms
All fees are quoted and charged in Thai Baht (฿). Current session prices are:
- Gentle Sorting Session: ฿3,700
- Wishes Recording Workshop: ฿18,000
- Family Records Programme: ฿34,000
Payment is due in full prior to or at the commencement of a session, unless otherwise agreed in writing. Accepted payment methods include bank transfer and cash. Receipts are provided on request.
Estora does not offer refunds for sessions already delivered. If a session is cancelled by Estora, a full refund will be provided or an alternative session scheduled at your choice.
6. Client Responsibilities
To make sessions as productive as possible, clients are asked to:
- Provide reasonably accurate information about the scope and volume of documents prior to a session
- Ensure that documents brought to a session are in your lawful possession
- Inform Estora in advance if any family members or third parties will be present during a session
- Not request Estora to perform any activity outside its stated scope (legal drafting, financial advice, etc.)
7. Confidentiality
Estora treats all information shared during sessions as strictly confidential. We will not disclose the content of any session to third parties without your explicit written consent, except where required by Thai law or a court order.
Clients are asked to treat any referral information or general guidance provided by Estora as for their own personal use only.
8. Intellectual Property
All materials, frameworks, and written tools used by Estora during sessions remain the intellectual property of Estora. Session summaries produced for you are yours to retain and use for personal purposes.
Content on the Estora website is protected by copyright. It may not be reproduced or redistributed without written permission.
9. Disclaimers
Estora's Services are provided in good faith on an organisational and educational basis only. We make no representation that any session outcome will satisfy a legal or administrative requirement. We strongly encourage all clients to seek advice from appropriately qualified professionals for matters requiring professional expertise.
Session summaries produced by Estora are organisational records, not legally operative documents.
10. Limitation of Liability
To the extent permitted by Thai law, Estora's total liability in connection with any engagement shall not exceed the fees paid for that specific session or programme. We exclude liability for indirect, consequential, or economic losses arising from the use of our Services.
Nothing in these Terms limits liability for fraud, death, or personal injury caused by negligence.
11. Indemnification
You agree to indemnify Estora against any claim, loss, or damage arising from your breach of these Terms, your misuse of our Services, or any inaccurate information you provide during an engagement.
12. Termination
Either party may end an ongoing engagement with reasonable written notice. For multi-session programmes, fees for sessions already delivered are non-refundable. Estora may terminate an engagement immediately if a client acts in a manner inconsistent with these Terms.
13. Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Kingdom of Thailand. In the event of a dispute, the parties agree to first attempt to resolve the matter through direct good-faith discussion. If that is unsuccessful, disputes shall be subject to the jurisdiction of the courts of Bangkok, Thailand.
14. General Provisions
- Entire agreement: These Terms, together with any session confirmation, constitute the entire agreement between you and Estora.
- Severability: If any provision is found to be unenforceable, the remaining provisions continue in full force.
- Waiver: Failure by Estora to enforce any provision does not constitute a waiver of that provision.
- Assignment: You may not assign your rights under these Terms without our written consent.
15. Changes to These Terms
Estora may update these Terms from time to time. The updated version will be published on this page with a revised "Last Updated" date. Continued use of our Services after changes are published constitutes acceptance of the revised Terms.
